A. Who Can Participate ?

1.This competition is open to all citizens or permanent residents of Malaysia, except the employees of MOG.

2.By participating in this contest, the contestants represent and warrant that:-
(a) they are eligible to participate in this contest under the law;
(b) they agree to be bound by these rules and regulations contained herein and the submission rules and registration form published on www.mog.com.my (“Submission Rules”), as may be amended, supplemented or modified from time to time by MOG at its sole and absolute discretion. 

3.The online contest participation form published on www.mog.com.my must be fully and accurately completed and submitted in accordance with the Submission Rules. 

 

B. How to enter?

1.The contest will be held from 20 March 2018 to 30 July 2018 (“Contest Period”). Entries received after 11.59 p.m. on 30 July 2018 (or such extended closing date determined at the sole and absolute discretion of MOG) or are damaged, corrupted, incomplete or illegible will not be accepted and will be disqualified. MOG may at its sole and absolute discretion extend the Contest Period at any time without any prior notice to any party whatsoever (“Extended Period”). Unless otherwise varied to the contrary by MOG, any participation in the contest during the Extended Period (if any) shall be governed by the terms and conditions set out herein which shall remain in full force and effect at all times. 

2.MOG reserves the right to modify the contest mechanisms, withdraw or terminate this contest at any time at its sole and absolute discretion without prior notice to any persons. 

3.All entries must meet each of the following requirements: 

(a)Each entry cannot be longer than five (5) minutes, excluding credits.

(b)Each entry must be submitted in accordance with these rules and regulations and the Submission Rules.

(c)The entry must be the contestant’s original work and no part or component thereof is copied from any other work or material. 

(d)Use of soundtrack – your soundtrack should either be your own original composition OR you MUST have written consent from the owner giving you express permission to use the soundtrack in your entry. When you use any soundtrack from third party sources, you must include a copy of their written consent or otherwise provide documentary proof that you have secured the right to use the soundtrack. These documents should be submitted together with your entry. Copyright theft will not be tolerated in the competition and may lead to immediate disqualification.

(e)Each entry and any part thereof shall not at any time infringe or violate any laws or the rights (including but not limited to privacy rights, intellectual property rights, copyright, moral rights, trade marks or business names) of any of third party.

(f)Each entry or any part thereof has never been displayed or published in all forms of media, including but not limited to the internet, radio, video, television broadcast and has never been used or submitted in connection with any contest held in or outside Malaysia.

(g)Each contestant has not granted or assigned any rights of any nature in his/her entry (or any part thereof) to any third party whatsoever in any part of the world (including but not limited to using the entry to participate in any other competitions and/or for other commercial purposes).

(h)   Each entry must be suitable for display and publication, in all forms of media, including but not limited to the internet, radio, video, television broadcast. Entries must not contain or suggest any obscene, nude or indecent elements, including but not limited to pornography or profanity, nor contain any offensive or defamatory statements including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group, nor include threats to any person, place, business, or group.

(i)The contestant must have the permission to use the audio and visuals of everyone featured in the video in any and all media without compensation.

(j)Each contestant must submit all required releases at MOG’s request, including a release from all persons appearing in the video.

(k)Incomplete, damaged, illegible or corrupted entries will be automatically disqualified. MOG shall not be responsible for lost, late, incomplete, damaged, illegible or misdirected entries.

(l)All costs and expenses in connection with the production of the entry and the participation of this contest shall be fully borne by the contestants.

(m)If the contestant at any point in time, is found to be in breach of any terms and conditions contained herein, MOG reserves the right to claim back all of the prize(s) awarded to the offending contestant.

4.  The contestants agree and acknowledge that MOG reserves the right to reject any entry at its sole and absolute discretion without having to assign or attribute any reasons whatsoever. 

5.  MOG shall not be responsible for technical, hardware or software malfunctions, lost or unavailable network connections, undeliverable entries, or failed, incorrect, inaccurate, incomplete, or delayed electronic and telephone communications, whether caused by the sender or by any of the equipment or programming associated with or utilized in this contest, or by any error which may occur in the processing of the entries in this contest. 

C. How are winners selected?

1.There are three (3) stages to the winner selection process:
(a) First stage: A panel of judges appointed by MOG at its sole discretion will select and shortlist ten (10) qualified and accepted entries (“Top 10 Entries”). The judges’ decision on all matters in connection with the contest is final, binding and conclusive.
(b) Second stage: The selected Top 10 Entries will be published on www.mog.com.my for ranking by the public. The entry with the highest number of number “1″ rankings will be the winner of “Best Votes Award”.
(c) Final stage: The selected Top 10 Entries will be screened at a live event for judging by a panel of judges. Each entry will be scored. The top 3 highest scored entries will win the Top 3 prizes, according to their respective scores. 

2.MOG reserves the right, in its absolute discretion, to substitute the prizes with items of similar value at any time without prior notice to any party including all the contestants. All prizes are non-transferable and non-refundable. 

D. Miscellaneous

1.   The contestant hereby irrevocably and unconditionally undertakes and confirms that from 01 April 2018 to 30 July 2018 (both dates inclusive) (“Exclusivity Period”), the contestant shall not submit the entries to participate in any other contests or competition in or outside Malaysia. Further, in consideration of the contestant’s entry(ies) being reviewed and evaluated for this contest, during the Exclusivity Period, the contestant irrevocably and unconditionally grants to MOG an exclusive, irrevocable, fully paid, perpetual, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display such entry, or any portion thereof, in any media now known or hereafter devised including, but not limited to, all forms of television, video and all forms of internet and wireless protocol without any further notice, permission, compensation or consideration. 

2.    In consideration of the contestant's entry being reviewed and evaluated for this contest and by participating in this contest, the contestant (including but not limited to the winners) hereby:
(a) grants permission to MOG to 
(i) collect and to use, store, publish, display or reproduce in any media, the contestant’s name, particulars and photograph(s), for any purpose whatsoever (including for MOG Group’s marketing or promotional activities of any kind) without further notice, permission, compensation or consideration. The contestant agrees that the results and proceeds of such use shall become and remain the property of MOG; and 
(ii) to disclose, make available and share the contestant’s particulars to any entities within MOG Group in or outside of Malaysia without further notice, permission, compensation or consideration; and 
(b) irrevocably and unconditionally grants to MOG an exclusive, irrevocable, fully paid, perpetual, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display such entry, or any portion thereof, in any media now known or hereafter devised including, but not limited to, all forms of television, video and all forms of internet and wireless protocol without any further notice, permission, compensation or consideration. Each contestant authorizes Berjaya, any entities within the Berjaya Group and any of MOG’s authorised representative (collectively referred to as the “Authorised Licensee”), to utilize, in any manner and at any time as they deem fit, the entry or any part thereof, and to make derivative works from such material. The contestant agrees that the results and proceeds of such use shall become and remain the property of the Authorised Licensee and shall be dealt with in any manner whatsoever at the discretion of the Authorised Licensee and its assignees which shall have no obligations whatsoever to the contestant. Each contestant hereby irrevocably and unconditionally waive, renounce and relinquish all claims it may have against the Authorised Licensee in connection therewith and fully release the Authorised Licensee from all such claims and any liability whatsoever in respect thereof. 

3.Each contestant shall indemnify and hold the Authorised Licensee harmless against all action, award, claim or other legal recourse, complaint, cost, debt, demand, expense, fine, liability, loss, outgoing, penalty or proceeding (including professional fees and costs) which may be suffered or incurred by the Authorised Licensee which arise directly or indirectly in connection with any breach or non-compliance with any of the rules and regulations contained herein and the Submission Rules or any part thereof. 

4.Notwithstanding anything stated or implied to the contrary in these rules and regulations or the Submission Rules, MOG shall not be liable to the contestants or any third party for death or personal injury, loss, damage (indirect, remote, special or consequential), costs or expenses of any nature in contract, tort, negligence, breach of statutory duty or otherwise howsoever arising. 

5. In the event of any dispute arising from this contest, the contestants irrevocably and unconditionally accept that the decisions of MOG are final and binding with regards to all matters in relation to and all aspects of this contest.
